Terms of Service

These Terms of Service ("Terms") form a legally binding agreement between you ("you", "User") and Guided ("Guided", "we", "us", or "our") and govern your access to and use of our website, applications, and related services (collectively, the "Service"). By creating an account, accessing, or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the Service.

1. Service Description

Guided is an AI-assisted reasoning platform designed to support structured thinking through Socratic-style guidance. The Service intentionally guides users toward conclusions rather than providing direct answers. Guided is not a search engine, a professional advisor, an educational institution, or a mental health service. The Service is intended for informational and exploratory use only.

2. Eligibility

You must be at least 13 years old to use the Service, or older where required by applicable law (16 in most of the European Economic Area, 18 in some jurisdictions). If you are under the age of legal majority in your jurisdiction, you must have verifiable consent from a parent or legal guardian. By using the Service you represent that you meet these requirements.

3. Account Registration

You may be required to create an account to access certain features. You agree to provide accurate, current, and complete information, and to keep your account information updated. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized access. We may suspend or terminate accounts that contain false information or violate these Terms.

4. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law, regulation, or third-party rights
• Make critical decisions in medical, legal, financial, psychological, or safety-related contexts without consulting qualified professionals
• Generate, request, or distribute illegal, harmful, hateful, harassing, defamatory, or sexually explicit content
• Attempt to identify, profile, or target real individuals without consent
• Reverse engineer, decompile, scrape, or attempt to extract source code or model behavior
• Submit malicious code, attempt to bypass rate limits, or interfere with the operation of the Service
• Use the Service to train competing AI systems or to create derivative datasets
• Misrepresent the source of AI-generated content, including in academic or professional settings where disclosure is required
• Use automated means (bots, scrapers, etc.) to access the Service without our written permission

5. Subscriptions, Payments, and Cancellation

Certain features of the Service require a paid subscription. All subscription fees are billed in advance on a recurring basis through our third-party payment processor and renew automatically until cancelled by you.

No Refunds. All fees paid are non-refundable. We do not offer refunds, partial credits, or prorated returns for any reason, including but not limited to unused tokens, partial billing periods, change of mind, dissatisfaction, or failure to use the Service during a paid period. This policy applies to the maximum extent permitted by applicable law.

Cancellation. You may cancel your subscription at any time through your account dashboard or the billing portal provided by our payment processor. Upon cancellation, your subscription will remain active until the end of the current billing period, after which your account will be downgraded to the free tier. You will not be charged for any subsequent billing periods.

Price Changes. We may change subscription prices at any time. Price changes will not apply retroactively and will take effect at the start of your next billing period. We will provide at least 14 days' notice of any material price increase.

Statutory Rights. If you are a consumer in a jurisdiction with mandatory withdrawal rights (such as the European Economic Area, the United Kingdom, or Turkey), you may have additional rights under local law. Where such rights apply, they override the no-refund policy stated above. By beginning use of the Service immediately upon purchase, you may waive certain statutory withdrawal rights where law permits.

6. Token Usage

Each subscription tier includes a monthly allowance of tokens that are consumed by interactions with the Service. Tokens reset at the beginning of each billing period and do not roll over. Unused tokens have no monetary value and are not refundable.

7. Intellectual Property

The Service, including all software, design, content, branding, and the Guided system prompts and reasoning methodology, is owned by Guided and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial use in accordance with these Terms.

You retain ownership of the content you submit to the Service ("User Content"). You grant us a worldwide, royalty-free license to process, store, and transmit your User Content solely as necessary to provide and improve the Service. You represent that you have all rights necessary to submit your User Content and that it does not violate these Terms or any third-party rights.

8. AI Output and Accuracy

The Service uses artificial intelligence to generate questions, prompts, and responses. AI-generated output may be inaccurate, incomplete, biased, outdated, or misleading. You are fully responsible for evaluating and verifying any output before relying on it. The Service is not a substitute for professional judgment, expert advice, or human review.

9. Mental Health and Safety

The Service is not a mental health, crisis, or therapeutic service. It is not designed to detect, diagnose, treat, or prevent any mental health condition. If you are experiencing emotional distress, suicidal thoughts, or a mental health crisis, stop using the Service immediately and contact a qualified professional, an emergency service, or a recognized crisis helpline in your country. The Service may not respond appropriately to crisis situations and should not be relied on for such purposes.

10. Third-Party Services

The Service relies on third-party providers for authentication, payment processing, hosting, and AI infrastructure. Your use of such services may be subject to their own terms and policies. We are not responsible for the acts, omissions, or content of any third-party service.

11. Availability and Changes

We strive to keep the Service available but do not guarantee uninterrupted access. We may modify, suspend, or discontinue all or part of the Service at any time, with or without notice. We are not liable for any downtime, data loss, or service interruption.

12. Suspension and Termination

We may suspend or terminate your account, with or without notice, if you breach these Terms, engage in fraudulent or harmful behavior, or for any other reason at our reasonable discretion. Upon termination, your right to access the Service ceases immediately and any unused tokens or subscription time are forfeited without refund. Sections of these Terms that by their nature should survive termination (including intellectual property, limitation of liability, indemnification, and governing law) shall survive.

13. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, or uninterrupted operation. To the maximum extent permitted by law, we disclaim all such warranties.

14. Limitation of Liability

To the maximum extent permitted by law, in no event will Guided, its affiliates, directors, employees, or service providers be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunities, arising out of or related to your use of the Service. Our total aggregate liability for any claim arising out of these Terms or the Service will not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) USD 50.

15. Indemnification

You agree to indemnify, defend, and hold harmless Guided and its affiliates from and against any claims, damages, losses, and expenses (including reasonable legal fees) arising out of or related to (a) your use of the Service, (b) your User Content, (c) your violation of these Terms, or (d) your violation of any third-party rights.

16. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Turkey, without regard to conflict-of-law principles. Any dispute arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the courts and enforcement offices of Istanbul, Turkey, unless mandatory consumer protection law in your country of residence requires otherwise.

17. Force Majeure

We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including acts of God, natural disasters, war, terrorism, civil unrest, government action, labor disputes, internet or telecommunications failures, or third-party service outages.

18. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect, and the unenforceable provision will be replaced by an enforceable provision that most closely reflects the original intent.

19. Entire Agreement

These Terms, together with our Privacy Policy and Disclaimer, constitute the entire agreement between you and Guided regarding the Service and supersede any prior agreements or communications.

20. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified through the Service or by email at least 14 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms. If you do not agree, you must stop using the Service.
